1. Agreement to Terms
By accessing and using the services of MK Contracts Ltd ("Company," "we," "our," or "us"), you ("Client," "you," or "your") agree to be bound by these Terms of Service and all applicable laws and regulations.
2. Services
MK Contracts Ltd provides construction and renovation services including:
- New construction projects
- Renovation and remodeling
- Commercial construction
- Maintenance and repair services
- Project consultation and design services
All services are subject to separate written agreements and contracts that will govern the specific terms of each project.
3. Project Agreements
Written Contracts
All construction projects require a written contract signed by both parties before work commences. The contract will specify:
- Scope of work and specifications
- Timeline and milestones
- Total project cost and payment schedule
- Materials and labor specifications
- Change order procedures
- Warranty terms
Quotes and Estimates
All quotes and estimates are valid for 30 days from the date issued unless otherwise specified. Final pricing may vary based on actual site conditions and material costs.
4. Payment Terms
- Deposit: A deposit may be required before work commences
- Progress Payments: Payments are typically scheduled based on project milestones
- Final Payment: Due upon completion and client approval
- Late Payments: Interest charges may apply to overdue accounts
- Disputed Amounts: Must be reported in writing within 7 days
5. Change Orders
Any changes to the original scope of work must be agreed upon in writing through a change order process. Changes may affect project timeline and cost.
6. Client Responsibilities
The Client agrees to:
- Provide accurate project information and requirements
- Obtain necessary permits and approvals
- Ensure site access for workers and equipment
- Make timely payments as agreed
- Comply with safety requirements on site
- Provide utilities and services as needed
7. Warranties
Workmanship Warranty
We provide a 12-month warranty on our workmanship from the date of project completion. This warranty covers defects in our installation and construction work.
Materials Warranty
Materials are covered by manufacturer warranties. We will assist in warranty claims but are not responsible for manufacturer defects.
Exclusions
Warranties do not cover:
- Normal wear and tear
- Damage from misuse or neglect
- Modifications by others
- Acts of nature or force majeure
8. Liability and Insurance
MK Contracts Ltd maintains appropriate insurance coverage including public liability and professional indemnity insurance. Our liability is limited to the value of the specific project contract.
9. Force Majeure
Neither party shall be liable for delays or failures in performance due to circumstances beyond reasonable control, including but not limited to acts of God, weather conditions, labor disputes, or government actions.
10. Intellectual Property
All designs, plans, and specifications created by MK Contracts Ltd remain our intellectual property unless specifically transferred in writing.
11. Dispute Resolution
Any disputes arising from these terms or our services shall be resolved through:
- Direct negotiation between parties
- Mediation by an agreed third party
- Arbitration under UK law if necessary
12. Termination
Either party may terminate services with written notice. Termination terms and compensation will be as specified in individual project contracts.
13. Governing Law
These terms are governed by English law and subject to the jurisdiction of English courts.
